Legal and policy experts have raised alarms over proposed Rule 3(4) in India's draft IT Rules amendments, which they say would allow the Ministry of Electronics and Information Technology (MeitY) to issue binding advisories, guidelines, and standard operating procedures without parliamentary oversight or judicial review. The concerns were voiced at a MediaNama event, highlighting that the rule could bypass democratic processes.
"This provision grants executive power to create binding rules on AI content, effectively sidestepping Parliament," one expert noted.
The draft rules are currently in the consultation phase, meaning the final text may change before notification. Proponents argue that faster executive action on harmful content can protect citizens more effectively than slow legislative processes. However, critics warn of potential misuse and lack of accountability.
