Florida Attorney General James Uthmeier has initiated a formal investigation into OpenAI, citing significant public safety and national security risks associated with the company's technology.

In a statement released on Thursday, Uthmeier expressed grave concerns that OpenAI's data and artificial intelligence systems could be "falling into the hands of America's enemies, such as the Chinese Communist Party." The investigation follows earlier reporting by Reuters about potential vulnerabilities in how OpenAI safeguards its technology.

Uthmeier specifically highlighted issues with ChatGPT, OpenAI's widely used conversational AI. He stated that the platform has been "linked to criminal behavior," including connections to child sexual abuse material and instances where it allegedly encouraged self-harm. The attorney general further suggested ChatGPT may have been used to "assist" the individual suspected in a recent shooting incident in Florida, though details remain under investigation.

"There are legitimate concerns that OpenAI's data and technology are falling into the hands of America's enemies," Uthmeier said in his statement.

The probe represents one of the most significant state-level actions against an artificial intelligence company to date, focusing on whether OpenAI has adequate safeguards to prevent misuse of its technology. The investigation will examine both the company's data protection practices and the potential for its AI systems to be exploited for harmful purposes.

This development comes amid growing scrutiny of AI companies' responsibilities regarding content moderation, data security, and the prevention of real-world harm. Florida's investigation could set precedents for how states regulate emerging artificial intelligence technologies and hold companies accountable for potential misuse.
